Sales Terms and Delivery Conditions
All prices are without engagement, in EURO, without value added tax,
which is charged separately.
The prices are valid in the Federal Republic of Germany.
Variations can be due to currency variations or change of the manufacturer prices.
The online – offer of Klaus Ziemer GmbH is a business-to-business (B2B)
offer. It is only addressed to manufacturer, professional persons, universities and other
government authorities, explicit not to private persons.
Delivery in Germany: Up to a value of EURO 500.00 (net, without VAT) we deliver EXW
Langerwehe, INCOTERMS 2020 and we charge shipping and packing costs as a lump sum of EURO 14.50.
From a net-amount of EURO 500.00 we deliver free (CPT buyer in Germany, INCOTERMS 2020).
Export Delivery: Delivery EXW Langerwehe, INCOTERMS 2020. If there is no other instruction,
we choose the forwarder and will bill the freight charges and all other additional costs to the buyer.
Payment: In Germany: from the date of invoice; 14 days with 2% discount, 30 days net.
Export: in accordance with declaration.
Complaints: are possible within 8 workdays after receipt of the product. In every case they have to be
announced to us in writing. A return of the product may occur only with our consent. If there are
entitled lacks for the elimination we have the choice between exchange or repair of the product or
refund of the purchase price. Complaints do not entitle the customer to stop his payment. Going on
claims of the customer for compensation are impossible, provided that these are not occurred through
coarse negligence or deliberate. In case of coarsely negligent or deliberate injury of our contractual or
the legal duties our liability is limited on the foreseeable damage; we do not take over a liability for
lack consequential damages. Claims according to the product liability law are not osculated by above arrangement.
Is in the quotation obviously a wrong price because of a mistake in the calculation or a transmission error, we are authorized to make an ex post price correction. Does the buyer disclaim to this correction or is ther no chance of an agreement of both contractual partners, we are allowed - as far as allowed by law - to use our right of withdrawal at any time, that must be notified in written form.
Warranty: Conforms to the legal regulations of Germany. For commerce products however the assurance/guarantee of the manufacturer is valid.
Reserved ownership exists up to the complete payment of the product.
Place of performance and venue is Düren.
We reserve technical changes.
Reprint, also in extracts, needs our written permission.
For printing errors we do not take over any liability.
